Phish singer could face felony charges

WHITEHALL, Jan. 3

Source says heroin found in Anastasio's car

Ernest "Trey" Anastasio, the lead singer of the rock-jam band Phish, was in court in Whitehall Wednesday for his arraignment on misdemeanor drug charges. The 42-year-old musician was smiling as he left court with his wife and children by his side.

But NewsChannel 13 has learned Anastasio had heroin in his car and it appears the district attorney is ready to up the charges against the former Phish front man to a felony.

Anastasio was arrested last month on Route 4 in Whitehall after a patrolman saw him swerve over the double yellow line.

According to court records, the arresting officer said “Anastasio was hyper and his hands were shaking very badly.

Anastasio told police he'd been smoking hashish and taking pills before his arrest.

According to court documents, "Anastasio admitted...he was in an argument with his wife earlier in the day...because he was taking the pills and he had a problem."

Police searched his car and found more than a half-ounce of prescription pain killers—that's enough for a felony charge—and some anxiety medicine.

In addition, there was one item that police couldn’t identify. NewsChannel 13 has learned from law enforcement sources that Anastasio also had a quantity of heroin in the car.

Washington County's district attorney wouldn't comment on the specifics of the case, but said he plans to present it to a grand jury.

Anastasio remains free on his own recognizance. After leaving Whitehall Court with his family, they hurried into a chauffeur driven van and drove off.

The district attorney says it is likely Anastasio will be ordered to take part in a drug re-habilitation program to avoid going to

i know some people wont read the whole thing becuase it starts off like all the articles written last month, but the new thing is its confirmed that he also had Herion in the car

yes I saw that, I wasn't aware he was heroin free before.

i hope he's not injecting it, only "chasing the dragon", even though thats still ****** up.

Also it says he was all hyper, with H,pills, and hash, wouldn't that make him not hyper, i thought painkillers were sedatives(?)

Any opioid in large amounts can cause a certain state of paranoia around officers of the law. That, or he had so much heroin and opioids in his system that he was hardly handling it.

Or... He was driving to get to a place to ingest, since the break from ingestion was getting to him.

A lot of those jam band guys do a speedball or two every show.

Hash is the cannabinoids extracted from the cannabis plant and put into a medium of ground up plant material (so that it has something to cling to) and it has the consistency of damp coals, the kind you start fires with.

It's no different than just smoking a lot of marijuana, with a different taste and less useless smoke in your lungs.

well that would explain the general strangeness surrounding his creativity of recent. I've only been able to listen to "Shine" like twice, I didn't buy his new one. AFIK pre 1998 he was heavy duty drug free... kinda illustrates a point I guess.

Hash is pure THC - blonde is less concentrated - as you continue to process it's gets darker - brown then black hash - tastes awesome and so smooth - just chills you out.

heroin is opiads....heroin metobolizes into morphine in something like 30 minutes after it enters the body.

That kind of seems a little far fetched. If there was heroin in the car why wasnt that brought up on the initial arrest. sounds like the media had a slow day and needed to embellish a story to me. That does happen.

Phish's Anastasio indicted on 3 felony counts

An upstate New York grand jury has indicted Trey Anastasio, the iconic lead singer of former Vermont-based jam band Phish, on seven counts arising from a December traffic stop in Whitehall, including three felony charges of illegally possessing prescription painkillers and driving while impaired.

The Washington County grand jury also filed misdemeanor counts accusing Anastasio of possessing heroin and an anti-anxiety medication that had been prescribed to someone else.

The indictment, signed Friday and made public Tuesday at the request of The Burlington Free Press, charges Anastasio with one count of felony drug possession, two counts of felony driving under the influence of alcohol and drugs, three misdemeanor charges of drug possession, and a traffic infraction.

Anastasio, 42, a part-time Richmond resident, faces up to 14 years in prison if convicted and sentenced to the maximum on all counts. All the charges, though, carry minimum sentences that involve no incarceration and permit a range of several years on the upper end.

No court date had been set, but Anastasio could be arraigned as early as Friday, the office of District Attorney Kevin Kortright said Tuesday. The prosecutor did not return messages Monday and Tuesday seeking comment.

Anastasio's file at Washington County Court in Fort Edward, N.Y., did not list a defense lawyer, a court clerk said. The musician could not be reached for comment Tuesday night at his Richmond home.

A Whitehall police officer pulled over Anastasio's 2004 Audi for failing to keep right as he drove north on U.S. 4 at about 3:30 a.m. Dec. 15, the department has said. He failed a sobriety test, was taken into custody and posed for a memorable booking photo that Rolling Stone magazine dubbed the "most bemused mug shot ever."

Police said Anastasio had three bottles of prescription drugs that belonged to other people.

Anastasio issued a one-line statement apologizing for the incident.

"I feel terrible about what happened last night, and I am deeply sorry for any embarrassment I have caused my friends, family and fans," he said.

During a hearing Jan. 3 in Whitehall, Anastasio pleaded not guilty to charges that included possession of a controlled substance and driving while intoxicated. Afterward, Kortright said he was considering presenting the case to a grand jury because of the quantity of drugs involved.

The grand jury's indictment says Anastasio possessed two prescription painkillers, hydrocodone and oxycodone; alprazolam, an anti-anxiety drug sold under the brand name Xanax; and heroin. The amount of hydrocodone, more than half an ounce, elevated the charge to a felony; the other drugs prompted misdemeanor charges, according to the three-page indictment.

Grand jurors also charged Anastasio with felony driving while ability impaired by drugs, and felony driving while intoxicated.

The arrest came more than two years after the breakup of Phish, which formed at the University of Vermont during the early 1980s. The band known early on for shows at Nectar's grew into a touring juggernaut that packed tens of thousands of fans into sold-out, festival-like performances.

The four-member group split up in 2004 and held a final, blowout, rain-soaked gig that August in Coventry.

In interviews since then, Anastasio has said the band's last few years included lots of drugs, but he said later he had stopped using narcotics and wanted to preach the values of sobriety.

Anastasio told Rolling Stone last week, according to a report on the magazine's Web site, that he has gone through rehab and had thanked the officer who arrested him in Whitehall because the incident forced him to face his addiction.

your taking the **** right? Hash is a peice of crap, weed is so more potent than hash it's unbelievable, hash is NOT pure THC, the stuff that sell for the dearest in europe is skunk, hash is like the behringer of the weed world.
